Regarding the method of calculating the number of days for menstrual leave as stipulated in the Regulations for Leave of Absence for Civil Servants.

Explanation:
1. Processed in accordance with the Ministry of Personnel's letter dated January 4, 108 (1084688889), with a copy of the original letter attached.

2. According to Article 3 of the Regulations for Leave of Absence for Civil Servants, female civil servants who experience difficulties in work due to menstruation may take 1 day of menstrual leave per month, up to a maximum of 12 days per year.
12 days per year, and if the total number of menstrual leave days taken in a year does not exceed 3 days, it will not be counted as sick leave.
The remaining days will be counted as sick leave. If the total sick leave plus menstrual leave counted as sick leave exceeds the granted sick leave days (28 days),
the excess portion will be offset by personal leave (7 days). If there is no personal leave to offset,
the salary (or pay) will be deducted on a daily basis.
3. Any previous interpretations by the Ministry of Personnel that are inconsistent with the above explanation shall cease to apply from January 4, 108.

三、銓敘部歷次函釋與前開解釋未合部分,自108年1月4日起停止適用。
