To inform you that the control period for former political appointees of the Taoyuan City Government entering mainland China has been adjusted to 3 years, and it will be implemented retroactively from September 1, 2019.

Explanation:

1. In accordance with the letter from the Mainland Affairs Council dated August 14, 2019, Ref. No. Lu Fa Zi No. 1080400567.

2. Attached is a copy of the original letter.

3. Article 9, Article 9-3, and Article 91 of the "Act Governing Relations Between the People of the Taiwan Area and the Mainland Area" have been amended and approved by the Executive Yuan on August 6, 2019, Ref. No. Yuan Tai Fa Zi No. 1080026109, and will be implemented from September 1, 2019.

4. Article 9, Paragraph 7 stipulates that former officials who fall under Article 4, Item 4 shall be subject to review and approval by the Review Committee before entering mainland China. The period of restriction may be extended by the original service agency, entrusted agency, or entrusted organization/institution based on national security, interests, classified information, and the nature of their duties.

5. In response to the aforementioned adjustment of the control period from a general 3 years with the possibility of extension or reduction to a minimum of 3 years, considering that the Taoyuan City Government's duties involve local autonomy and the implementation of matters delegated by the central government, and the degree of involvement with national classified information is relatively low, the control period for former political appointees of the Taoyuan City Government entering mainland China has been changed to 3 years, and will be implemented retroactively from September 1, 2019.

規定，第4項第4款所定退離職人員退離職後，應經審查會

審查許可，始得進入大陸地區之期間，原服務機關、委託

機關或受託團體、機構得依其所涉及國家安全、利益、機

密及業務性質增加之。

三、配合前述列管期間由原則3年得予增減修正為最少3年，考

量桃園市政府所涉業務為本市自治與執行中央委辦事項，且涉及

國家機密事項程度較低，爰桃園市政府爾後退離職政務人員進入

大陸地區管制期限更改為3年，並溯自108年9月1日起實施。
