For your information, attached are the sample "Self-Recusal Notification for Public Officials Regarding Conflict of Interest" and "Interested Party's Application for Recusal of Public Official".

Details:

1. In accordance with the letter from the Taoyuan City Government, ref. no. 1070315670, dated December 18, 2018, forwarding the letter from the Ministry of Justice, ref. no. 10705012750, dated December 11, 2018.

2. Article 6 of the newly amended Act on Prevention of Corruption and Deterrence of Bribery (hereinafter referred to as "the Act") stipulates that public officials who are aware of a conflict of interest shall immediately recuse themselves and shall do so in writing.

Article 7, Paragraph 1 of the Act further stipulates that an interested party who believes a public official has a conflict of interest that requires recusal, but has not recused themselves, may apply to the agency or organization referred to in Article 6, Paragraph 2 or 3 for recusal.

The Ministry of Justice has designed the aforementioned notification and application form templates for agencies to reference and utilize. Electronic copies are available on the Taoyuan City Government's Department of Government Ethics / Sunshine Laws / Conflict of Interest Zone / Forms section. Any amendments to the templates will be announced online in a timely manner.

3. Furthermore, in accordance with Article 11 of the Act: "The agency or organization where the public official serves, the superior agency, or the agency that appoints, selects, or hires the public official shall, within thirty days after the end of each year, report the public official's self-recusal, application for recusal, and recusal of duties during the previous year to the disciplinary authority specified in Article 20, and shall submit the report to the Control Yuan or an agency (organization) or unit designated by the Ministry of Justice."

Considering that the period from the enforcement of the Act on December 13, 2018, to December 31, 2018, is less than one full year, a separate letter with the reporting format will be sent before the end of the 2019 reporting year, requesting agencies to report on the recusal situations of public officials subject to the jurisdiction of the Ministry of Justice as stipulated in Article 20 of the Act.

三、次依本法第11條規定：「公職人員服務之機關團體、上級

機關、指派、遴聘或聘任機關應於每年度結束後三十日

內，將前一年度公職人員自行迴避、申請迴避、職權迴避

情形，依第二十條所定裁罰管轄機關，彙報予監察院或法

務部指定之機關（構）或單位」，審酌本法自107年12月13

日施行至同年12月31日期間未滿一年度，故將於108年年度

結束前，另行檢附彙報格式函請各機關就本法第20條所定

法務部管轄之公職人員迴避情形彙報。
